Welcome to HERE! These Terms and Conditions ("Terms") govern your access to and use of our mobile application HERE ("App") and related services (collectively, the "Services"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

• Service Description: The App provides tools to enhance well-being, such as affirmations, meditations, and a personal journaling feature.
• Eligibility: You must be at least 18 years old to use the Services. If you are under this age, you may not use the App.

To access certain features, you may be required to create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

You agree to:

• Not share your account credentials with anyone.
• Notify us immediately if you suspect unauthorized access or breach of your account.
• Take full responsibility for all activities that occur under your account.

You agree to use the Services only for personal, non-commercial purposes and in compliance with all applicable laws and regulations.

• Reverse-engineering, copying, or reselling the App or any portion of it.
• Uploading harmful or malicious content, such as viruses or spyware.
• Engaging in any activity that disrupts the App's functionality or harms its reputation.
• Collecting or harvesting information about other users without their consent.

The App may offer both free features and premium features available via subscription plans and in-app purchases ("Paid Services").

• If you subscribe to Paid Services, you agree to provide accurate billing information and authorize us (or our third-party payment processor) to charge the applicable fees.
• Subscription fees are billed periodically (e.g., monthly or annually), as specified on the Subscription screen.
• All payments are non-refundable unless required by law or explicitly stated in our Refund Policy.

You can cancel your subscription at any time through the platform where the subscription was purchased (e.g., App Store, Google Play). Cancellation will apply at the end of the current billing cycle.

The App allows you to create and store personal content, such as journal entries. You retain ownership of the content you upload or create using the App.

By using the App, you grant us a limited, non-exclusive license to process and store your content solely for the purpose of providing the Services.

The App and its content (excluding user-generated content) are owned by us and are protected under intellectual property laws. You are granted a limited, non-transferable license to use the App solely for personal purposes.

You may not reproduce, distribute, or modify any part of the App without our prior written permission.

Your use of the App is also governed by our Privacy Policy, which outlines how we collect, use, and protect your data. By using the App, you acknowledge and accept the terms of our Privacy Policy.

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. We make no guarantees or warranties of any kind regarding:

• The availability, accuracy, or reliability of the Services.
• The suitability of the App for achieving your well-being goals.

To the fullest extent permitted by law, we disclaim all warranties.

To the extent permitted by law, we are not liable for:

• Any indirect, incidental, or consequential damages arising from your use of the App.
• Loss of data, including journaling entries, due to technical errors or unauthorized access.
• Issues caused by third-party services integrated with or used by the App.

Our total liability, in any case, shall not exceed the amount you paid for the App in the past 12 months, if applicable.

We reserve the right to suspend or terminate your access to the Services at any time, without prior notice, if:

• You violate these Terms.
• We discontinue the App or any part of the Services.

Upon termination, you will lose access to your account, and all associated content may be deleted.

These Terms are governed by the laws of United Kingdom, without regard to its conflict of laws principles. Any disputes shall be resolved in the courts located in London, United Kingdom.

We reserve the right to update these Terms from time to time. Any changes will be effective upon posting the updated Terms within the App. Continued use of the Services after updates constitutes your acceptance of the revised Terms.
